By accessing or using HireOTR ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
1. Overview
HireOTR is an online recruitment platform that connects Commercial Driver's License (CDL) holders with motor carriers and employers in the trucking industry. We provide tools for driver profile creation, job posting, candidate matching, application management, and document verification.
2. Eligibility
To use HireOTR, you must:
- Be at least 18 years of age (21 for interstate CDL positions per FMCSA regulations)
- Have a valid email address
- Provide accurate and truthful information
- Have the legal right to work in the United States (for driver accounts)
- Have proper operating authority (for carrier/employer accounts)
3. Account Types
3.1 Driver Accounts
Driver accounts are free to create and use. Drivers may create a profile, upload documents, apply for jobs, and be contacted by employers. Drivers are responsible for keeping their profile information current and accurate.
3.2 Employer/Carrier Accounts
Employer accounts allow carriers and companies to search for drivers, post job listings, and manage applications. Employer accounts may be subject to usage limits based on subscription plan:
- Free Plan: Limited monthly driver profile views and basic search
- Starter Plan: Increased views, full profile access, and priority support
- Professional Plan: Unlimited views, advanced matching, and analytics
- Enterprise Plan: Custom solutions with dedicated support
3.3 Admin Accounts
Admin accounts are reserved for HireOTR staff for platform management and moderation purposes.
4. Acceptable Use
You agree NOT to:
- Provide false, misleading, or fraudulent information in your profile or applications
- Impersonate another person or entity
- Use the Platform for any illegal purpose
- Attempt to access other users' accounts or private data
- Scrape, crawl, or use automated tools to extract data from the Platform
- Circumvent rate limits, usage restrictions, or security measures
- Upload malicious files, viruses, or harmful content
- Harass, threaten, or discriminate against other users
- Post job listings that violate FMCSA regulations or labor laws
- Use contact information obtained through the Platform for spam or unsolicited marketing
Violation of these terms may result in immediate account suspension or permanent ban without notice.
5. Driver Information Accuracy
Drivers represent and warrant that all information provided on the Platform is accurate, including but not limited to:
- CDL class, number, and endorsements
- Clearinghouse status
- DOT violation history
- Accident history
- Employment history
- Medical card status and expiration
Providing false safety or credential information may constitute fraud under federal law and will result in immediate account termination.
6. Employer Responsibilities
Employers and carriers agree to:
- Comply with all FMCSA, DOT, and applicable federal/state employment regulations
- Provide accurate job descriptions, compensation information, and company details
- Conduct their own independent verification of driver credentials before hiring
- Not discriminate in hiring based on race, color, religion, sex, national origin, age, disability, or other protected characteristics
- Respect driver privacy and only use information obtained through the Platform for legitimate recruitment purposes
7. Matching and Verification
HireOTR provides an algorithmic matching system that calculates compatibility scores between drivers and job requirements. These scores are provided for informational purposes only.
Important: HireOTR does NOT guarantee the accuracy of any user-submitted information. Employers must independently verify all driver credentials, safety records, and employment history before making hiring decisions. HireOTR's "verified" badge indicates that we have performed basic checks, but does not substitute for employer due diligence.
8. Documents and Uploads
- You retain ownership of all documents you upload to the Platform
- By uploading, you grant HireOTR a limited license to store, display, and transmit these documents as necessary to operate the Platform
- Maximum file size: 10MB per document
- Accepted formats: JPEG, PNG, WebP, PDF
- You are responsible for ensuring you have the right to upload any document
- You may delete your documents at any time through your account settings
9. Payments and Subscriptions
Paid subscription plans are billed according to the selected billing cycle. By subscribing, you authorize HireOTR to charge your payment method on a recurring basis. You may cancel your subscription at any time; access continues until the end of the current billing period. Refunds are handled on a case-by-case basis.
10. Intellectual Property
The HireOTR platform, including its design, code, matching algorithm, logos, and content, is the property of HireOTR and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without written permission.
11. Limitation of Liability
To the maximum extent permitted by law:
- HireOTR is provided "as is" without warranties of any kind
- We do not guarantee continuous, uninterrupted, or error-free operation
- We are not liable for any hiring decisions made based on Platform information
- We are not responsible for the actions, conduct, or content of any user
- We are not an employer and do not provide employment, staffing, or labor services
- Our total liability shall not exceed the amount you paid to HireOTR in the 12 months preceding the claim
12. Indemnification
You agree to indemnify and hold harmless HireOTR, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
13. Account Termination
We reserve the right to suspend or terminate any account at our discretion, particularly in cases of Terms violation, fraudulent activity, or harmful behavior. Upon termination, your right to use the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes.
14. Dispute Resolution
Any disputes arising from these Terms or your use of HireOTR shall be governed by the laws of the State of Illinois, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Illinois for resolution of any disputes.
15. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated via email to registered users. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
